INVITATION TO TENDER/EXPRESSIONS OF INTEREST

1.0 INTRODUCTION
The National Information Technology Development Agency (NITDA) intends to undertake the execution of some of its projects (NITDEF) for the 2023 financial year.

2.0 DESCRIPTION OF WORKS
In compliance with Public Procurement Act, 2007, NITDA invites interested, competent and reputable contractors/consultants with relevant experience and good track records to submit documents necessary for consideration for the execution of NITDA programmes/projects:

3.0 ELIGIBILITY CRITERIA:
Interested firms are required to submit the following documents:
a) Evidence of certificate of Incorporation issued by Corporate Affairs Commission (CAC) including Forms CAC 1.1 or CAC2 and CAC7. Business Name is also acceptable for services;
b) Evidence of Company’s Income Tax Clearance Certificates (or personal Income Tax Clearance Certificates for all partners) for the last three (3) years (2019, 2020 and 2021) valid till 31st December 2022;
c) Evidence of Pension Clearance Certificate valid till 31st December, 2022 (this requirement is only applicable to bidders whose number of staff is 15 and above).
d) Evidence of Industrial Training Fund (ITF) Compliance Certificate valid till 31st December, 2022 (this requirement is only applicable to bidders whose number of staff is 5 and above or the bidder’s annual turnover is N50m and above);
e) Evidence of current Nigeria Social Insurance Trust Fund (NSITF) Compliance Certificate valid till 31st December, 2022;
f) Evidence of Registration on the National Database of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 31/12/2022 or valid Certificate issued by BPP;
g) Sworn affidavit
• disclosing whether or not any officer of the relevant committees of National Information technology development Agency or Bureau of Public Procurement (BPP) is a former or present Director, shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars.
• That the company is not bankrupt, in receivership or under liquidation or involved in any litigation which can potentially affect the company’s ability to effectively discharge their responsibility if engaged.
• No company’s Director has been convicted of criminal offences relating to fraud or financial impropriety in any court of law

h) Company’s Audited Accounts for the last three years (2019, 2020, 2021)(turnover must correspond with tax clearance certificate);
i) Reference letter from a reputable commercial bank indicating willingness to provide credit facility for the execution of the project when needed;
j) Company’s Profile with Curriculum Vitae of key staff to be deployed for the project, including copies of their academic/professional qualifications such as COREN, QSRBN, ARCON, CORBON etc
k) Verifiable documentary evidence of at least three (3) similar jobs executed in the last five (5) years including letters of awards, valuation certificates, job completion certificates and photographs of the projects;
l) Works: list of plants/Equipment with proof of Ownership/Lease;
m) ICT Jobs:
• evidence of current registration/accreditation with Computer professionals registration Council of Nigeria and national Information Technology development AGENCY (NITDA);
• ISO 27001 and ISO 20000 Certifications where applicable;
n) For supply of Equipment: Letter of Authorization as representative of the Original Equipment Manufacturer (OEMs)
o) For Joint Venture/partnership, Memorandum of understanding (MoU) should be provided (CAC, Tax Clearance Certificate, Pension Clearance Certificate, ITF Compliance Certificate, NSITF Clearance Certificate, IRR & Sworn Affidavit are compulsory for each JV partner);
p) All documents for submission must be submitted with a Covering/Forwarding letter under the Company’s letter head paper bearing amongst others, the Registration Number (RC) as issued by the CAC, Contact Address, Telephone Number (preferably GSM No) fax and email address. The letter head paper must bear the Names and Nationalities of the Directors of the company at the bottom of the page, duly signed by the authorized officer of the firm.

4.0 COLLECTION OF TENDER DOCUMENTS (GOODS & WORKS)
Standard bidding documents for Goods, Works and Services are to be collected from the Procurement Unit, National information technology development Agency (NITDA). This is upon presentation of N10, 000:00 (Ten Thousand Naira) Bank Draft payable in NITDA’s name from any reputable Commercial Bank in Nigeria

5.0 SUBMISSION OF TENDER DOCUMENTS (GOODS & WORKS)
i. All respondents should submit two copies of their technical and financial (in hard and editable soft copy) Bids each in separate sealed envelops
ii. Each bid should be clearly marked “TECHNICAL” or “FINANCIAL” and clearly write the company Name, Address and lot Numbers of projects bided for. All sealed envelopes should be put in an A3 size envelope and marked “TECHNICAL/FINANCIAL BID FOR LOT ….”
iii. All bidders must fill in the Bid submission Register at the PROCUREMENT UNIT, Room B005 NITDA headquarters and thereafter drop the documents in the Tender Box
iv. All documents must be submitted on or before 12:00 noon Monday, 20th February 2023
v. All documents should be addressed to:

6.0 SUBMISSION OF EXPRESSION OF INTEREST
Interested firms in services are to submit the expression of interest (EOI) for each of the Lot desired, in three (3) hard copies each (one original & two copies). The EOI should be addressed as indicated above and submitted not later than 12:00 noon on Monday, 6th February 2023.

7.0 OPENING OF EOI AND TECHNICAL BIDS
i. Expression of Interest will be opened immediately after the deadline for submission at 12:00 noon on Monday, 6th February 2023.
ii. Only Technical bids and proposals will be opened immediately after the deadline for submission at 12:00 noon Monday 20th February 2023.
iii. Bidders or their representatives and interested members of the public are hereby invited to witness the bid opening exercise.

8.0 NOTATION
i. Any EOI/bid received after the deadline for the submission of bid shall not be opened; such bid shall be returned unopened.
ii. Bidders should endeavor to follow the order of instructions in the submission.
iii. Illegal documents in company’s profiles shall lead to disqualification.
iv. No company is allowed to bid for more than two (2) Lots.
v. Mobilization fee shall only be considered subject to presentation of performance Bond of not less than 10% from reputable bank/insurance firm on ward of contract.
vi. The National Information Technology Development Agency is neither committed nor obliged to award any contract to any bidder or to the lowest tender that is not responsive.
vii. The agency shall not be responsible for any cost incurred by the bidder in the preparation and submission of documents in connection with this advertisement.
viii. All certificates are subject to verification and a bid stand disqualification if any certificate is found to be forged with possibilities of prosecution;
ix. Work & Goods: only prequalified bidders at technical evaluation will be invited at later date for virtual financial bids opening, while the financial bids of un-successful bidders will be returned to them un-opened;
x. Services: Only shortlisted firms will be invited at a later date for collection of request for proposals;
xi. The National Information Technology Development Agency is not bound to pre-qualify/shortlist any bidder and reserves the right to annual the Procurement Process at any time without incurring any liabilities in accordance with section 28 of the public Procurement Act 2007.
